A police officer who attended the scene of Anna Nicole Smith's death has told of seeing her boyfriend Howard K. Stern fall to his knees and weep when he found out his lover had passed away.
But a lawyer for Stern, Steven Sadow, told the court Smith was taking drugs to deal with chronic pain and she was not an addict, insisting false names were only used on the prescriptions to protect Smith's privacy
Stern is currently on trial in California along with two doctors accused of conspiring to supply the late star with strong prescription pills inthe run-up to her fatal accidental overdose in 2007.
A police officer who was assigned to the Florida hotel room where Smith's body was found was the first witness to take the stand at the trial onThursday (05Aug10) and she told the court cops found a number of pill bottles and a duffel bag stuffed with $8,000 (£5,333) in cash at the scene.
Detective Katherine Frank also testified about Stern's reaction to the news, revealing he broke down in the hotel room after Smith's body was taken away, according to the Associated Press.
She told the court, "He was visibly shaken with reddened eyes, tears and trembling".
Stern, along with doctors Khristine Eroshevich and Sandeep Kapoor, are accused of unlawfully prescribing and giving controlled substances to an addict for three years, amid allegations a variety of false names were used to obtain the pills for Smith.
But a lawyer for Stern, Steven Sadow, told the court Smith was taking drugs to deal with "chronic" pain and she was not an addict, insisting false names were only used on the prescriptions to protect Smith's privacy.
He said, "He (Stern) cared for her, he cherished her, he loved her. He relied in good faith on the medical judgment of doctors".
Stern, Eroshevich and Kapoor have all pleaded not guilty to the charge.
